FUNCTIONING OF INTEGRATED AGRARIAN SECTOR COMPANIES ON THE FUNCTIONS OF MECHANISM OF THE STATE-PRIVATE PARTNERSHIP

Abstract

The article explores the components the regulatory legal method of regulation for the purpose of effective management of an integrated agrarian enterprise under the conditions of the mechanism of public-private partnership as a component of the policy of modernization of the national economy of Ukraine. The legal base of development of public-private partnership in agriculture and fish industry was substantiated. Characteristic features of the action mechanism of state-private partnership in agrarian sector of economy are disclosed. The mechanism of fair compensation in the event of early termination of the contract of public-private partnerships on the initiative of the public partner to reimburse reasonable losses integrated agricultural enterprise and mechanism for guaranteeing the financing of the project public-private partnership by the public partner during the entire implementation period of the project are deepened and improved. Foreign experience of public-private partnerships in the national economy was studied. The basic principles of such cooperation are highlighted. Draws attention to the fact that the state determines what services and infrastructure are adequate, and private investors to form appropriate proposals that meet the requirements of the state. The authors suggested that the Budget code refund-integrated agricultural enterprises in the event of failure by the state taken in the framework of the agreement on public-private partnership obligations, the difference in fares, inconsistencies of demand for the service scheduled level. In the article the problematic question on redistribution of powers for creation of public infrastructure, performance of works, rendering of services, which were traditionally considered the monopoly of the state, a settlement between the parties of disputed issues are raises. It is concluded that for the further development of the agricultural sector and fisheries in particular, which are in the process of global processes, it is important to take into account global economic trends, the ability to use a variety of mechanisms, methods, instruments of regulation to achieve the objectives of the state agrarian policy.
