Gender-based violence issues in Ukraine

Abstract
The article deals with the problem of gender-based violence issues in Ukraine. Special attention is paid to the analysis of legislation. The article deals with legal regulation in the field of gender equality. The article analyses the provisions of the Constitution of Ukraine, which guarantee the prohibition of any type of restrictions on grounds of gender, social origin, and any other differences. These provisions are the basis of other normative legal acts. These legal acts establishes the definition of gender equality, namely the equal legal status and opportunities for its proper realisation by women and men, which create for both sexes an equal participation in all areas of life in Ukraine. The article pays special attention to the historical preconditions of the gender doctrine in the national legal science. The author draws attention to the types of gender, namely - biological and social. The development of Ukraine as a democratic European country has caused radical changes – these have consisted of numerous international treaties, recognises, which have enshrined the freedom of individuals from discrimination. These changes have taken place in the legal and social life of the country. The legal culture of society regarding men and women’s roles has developed, which has affected the consciousness of Ukrainian citizens. This has led to the adoption of a number of normative documents defining the concept of gender equality, gender discrimination, violence on the basis of gender, as well as legal jurisdiction for their commission. The ratification of The Council of Europe Convention on Preventing and Combating Violence Against Women and Domestic Violence (2011) is an ongoing process, which raises numerous unsolved problems, for example, it is necessary to fill the gaps in legislation, and align national standards with those of the EU. That is why the research on gender-based issues in Ukraine is so important.
