General permitting type of legal regulation (history of recognition)

Abstract
The article analyzes stages of general permitting regime of legal regulation, which presently can be regarded as one of possible directions of legal personality development. During the analysis it was established that there is an issue of the scope of legal prohibitions that forms, or rather, cuts the scope of legal permissions, i.e. legal freedom. Accordingly two possible ways to study the properties of general permitting “legal matter” are offered, namely: through the study of history of “legal turnover” of prohibitions and their limits, and history of manifestation of the freedom concept in the legal area. It was revealed that normative regulation of freedom is the factor that has caused legalization of general permitting legal regulation. It was established that such regulation in no way assumed the permission to do anything; first and foremost it has changed the philosophy of prohibitions. It has formed the new purpose of prohibitions, which is to serve general public interest; that in turn has radically changed the social orientation vector of the positive law.
