GENERAL PRINCIPLES OF LAW AS A REGULATOR OF INTERNATIONAL RELATIONS: CONCEPT AND SIGNIFICANCE

Abstract

The article describes the current scientific views on the nature and role of the general principles of law as a regulator of international relations. The category «general principles of law recognized by civilized nations» is analyzed in the context of different philosophical and theoretical approaches to the comprehension of law, different points of view on the understanding of their content and types are presented. The author comes to the conclusion that a gradual change of attitude to the general principles of law in the science and practice of international law in connection with changes in the system of international relations and the crisis in their international legal regulation is happening. The trend towards increasing frequency of their use in the practice of international courts is emphasized.
