Soru: Bir hadise hakkında şer’î hükmü açıklamak için o şer’î hükmün her du-rumda fıkıh kitaplarında apaçık beyan olunması gerekli midir? Şer’î hüküm apaçık beyan olunmadığı durumlarda, fıkıh kuralları sayesinde şer’î hükmü açıklayamaz mıyız? Şer’î hükmü açıklayabilirsek müçtehit olmamız gerekmez mi? Müçtehitten baş-kası şer’î hükmü açıklayabilir mi?
