ILLEGAL BEHAVIOUR AS A CONDITION OF TORT LIABILITY IN THE CIVIL LAW OF UKRAINE AND THE USA

Abstract
In the article doctrinal and applied aspects of the problems connected with qualification of behavior of the injurer as illegal in the civil law of Ukraine and the USA are studied. It is paid the attention that doctrinal approaches to determination of illegality as a condition of tort liability, in the defined countries has the certain features that caused, first of all, by differences of approaches to legal regulation of the tort relations in Ukraine and the USA. At the same time, it is noted that in the USA separate types of illegal behavior which cause harm, are defined in special acts. However, as a rule, these offenses are not defined as “torts”.
