Implementation of Private Law Institutions into Public Law on the Example of Mediation in the Code of Administrative Procedure – Remedy or Placebo?

Abstract
This article is an attempt to critically evaluate the implementation of the Polish Code of Conduct for the Administration of Mediation Institutions. The author considers the legitimacy of the use of private-law institutions in public law. For this purpose, the data on the mediation introduced over a decade ago before the administrative courts, whose assumptions are currently being duplicated, are analysed. They conclude that administrative mediation is an unnecessary solution, and its introduction into the legal system is a mistake. The author also proposes a solution de lege ferenda, indicating that the key is the de-institutionalization of administrative law.<br/><br/>
