Informal practices in restoring lost materials of criminal proceedings and possible ways to resolve them

Abstract

The article is dedicated to the problem connected with the loss of materials of criminal proceedings and, in connection with this, their restoration in Ukraine under the conditions of the occupation of the Autonomous Republic of Crimea and the conduct of the anti-terrorist operation in Lugansk and Donetsk regions, which gained a considerable theoretical and practical interest in the study of criminal procedural rights. The urgency of the study is to restore the materials of criminal proceedings in courts in the temporarily occupied territory, in case of impossibility of their transfer, due to the risk of violating the constitutional rights of victims and / or accused. Therefore, the settlement of the question is relevant. Loss of materials of criminal proceedings, the decisions of which have not been executed or not valid, is an obstacle for the citizens to exercise the right to judicial protection provided for by the Constitution of Ukraine and guaranteed by the first part of Article 6 of the Convention on the protection of the rights and fundamental freedoms of the right to a fair trial. Thus, the loss of materials of criminal proceedings jeopardizes the protection of the rights and legitimate interests of individuals and legal entities. The result of the study is a list of innovations that are desirable in today’s work of prosecutors and courts, especially in the situation with the citizens of Ukraine, criminal proceedings against whom are lost, that requires from the state authorities the improvement of existing information systems and accelerating the process of implementing new modern information technologies.
