INFORMATIONAL TOOLS OF THE FRAMEWORK AGREEMENT IMPLEMENTATION UNDER HARMONIZATION OF LEGISLATION WITH EUROPEAN DIRECTIVES

Abstract

Introduction. The introduction of legal norms concerning the implementation of framework agreements in public procurement led to the need to develop informational tools to ensure their implementation. The essence of tools in the part of methodological provisions is to be harmonized with the European directives on public procurement. Purpose. The study aims at the improvement of information provisions of the public procurement management in the use of framework agreements in terms of harmonization of legislative norms with European directives in this area. Methods. The method of analysis is used in considering individual examples of applying framework agreement to one or more participants in tender procedures, and the method of synthesis is applied when considering the formation of a summary of the results of government procurement. The comparative method and system analysis method are applied to review the national and European public procurement practices. Results. The provision on applying the framework agreements on the legislation on public procurement is analyzed, informational tools of the framework agreements procedures are set out that serve as accounting provision for public procurement and is consistent with the standards and experience of EU countries, regulations on framework agreements under EU Directives on public procurement are evaluated. Advantages of applying framework agreements are set out, which are to shorten the procurement time with the quantity of tender procedures. The feasibility of using framework agreements for centralized procedures is established. Discussion. Comparison of the framework agreements standards in Ukrainian law with the EU directives in public procurement procedures proved the harmonization of provisions of their conduct. Informational tools for the framework agreements procedures are suggested. Further research in this area is to be focused on analytical assessment of the feasibility of applying framework agreements using the electronic system of public procurement.
