INTENTIONALLY ILLEGAL INJURING, DESTRUCTION OR DAMAGING OF THE OBJECTS OF CULTURAL HERITAGE: PROBLEMS OF DETERMINING THE SIGNS OF THE OBJECTIVE PART OF THE CRIME

Abstract
The article deals with some issues concerning the content of the signs of the objective side of the bodies of crimes provided for in parts 2–5 of Art. 298 of the Criminal Code of Ukraine. In particular, the content of such features as an act, socially dangerous consequences have been considered. On the basis of the analysis of legislation, scientific positions the author has formulated the definition of the concepts of the injuring, damaging to the object of cultural heritage, its part as a socially dangerous consequences, has proposed the definition of the act in this body of the crime.
