International aspects of intellectual property protection

Abstract

Due the rapid development of science and technology human intellectual activity is becoming more important in various fields of material and spiritual production. All the latest scientific achievements and works of art are the result of creative work and are the intellectual property (hereinafter - IP). For a long time legal regulation of relations arising in connection with the use of intellectual property, considered entirely for the national laws of that thus encourage creativity and promote effective free trade results of intellectual work for economic and social development. Countries in different ways tried to settle the balance between the rights of creators in their works and the right of society to have free access to these works. As a result, there are numerous inconsistencies between national laws on the protection of IP rights. The rights recognized in one country in the absence of specific international agreements for other countries existed. At the level of individuals is often led to the use of the work or invention without the consent of the author or inventor and without paying him a fee, at the international level is - the loss of the rights of countries to new technologies. It was found that no clear rules regulating the use of intellectual benefits almost impossible to international cooperation in all fields of human knowledge: in the field of scientific research in medicine, nanotechnology, military areas in the field of culture and so on. The system of international protection of IP rights seems relatively stable, but in reality this structure is subject to constant turmoil. New challenges and challenges force participants in international cooperation on IP to continuously review the contractual framework of their relationships. This allows them to adapt their national laws to changing realities and, at the same time, continue to harmonize them. The trend towards modernization of international norms and standards, before bringing these standards into line with the requirements of time, complements the picture formed in the field of international regulation of IP rights. It is expected that these trends will continue to be further strengthened. International cooperation in the field of IP protection will promote their development. However, it is itself experiencing the influence of a number of positive and negative factors, the ratio of which determines the fruitfulness of the joint efforts that are made on the international level.
