Journal Title: Порівняльно-аналітичне право - Year 2016, Vol 6, Issue
Abstract
The legal basis and forms of implementation of the international cooperation and judicial assistance by the International Criminal Court are examined in the article. The features of the implementation by the International Criminal Court of the international cooperation and assistance with the member countries of the Rome Statute, countries which are not its members, international intergovernmental and international nongovernmental organizations were analyzed. It was established that unlike the member countries of the Rome Statute which are required to run queries of the Court, the decision to meet the request of a member country of the Rome Statute is a right of the Court, not its obligation. It was determined that in the relations between the Court and countries which are not members of the Rome Statute, international intergovernmental and international nongovernmental organizations, the main legal bases for their cooperation and assistance are specifically concluded international agreements (special agreements or arrangements).
