INTERNATIONAL INVESTMENT LAW AND ARBITRATION: EXPERIENCE ON THE LEGISLATION OF THE REPUBLIC OF AZERBAIJAN AND ICSID DECISIONS

Abstract
Abstract This essay provides a comprehensive overview of international investment law, highlighting its evolution from customary norms to a structured legal framework. It discusses the rise of international investment law, tracing its roots from early trade practices to modern arbitration systems. The role of the International Centre for Settlement of Investment Disputes (ICSID) is explored, detailing its establishment, jurisdiction, and procedures for arbitration and conciliation in investment disputes. The essay also examines Azerbaijan's legal framework for foreign investment, emphasizing protections, rights, and obligations of foreign investors, and analyzes two significant ICSID arbitration cases involving Azerbaijan: Azpetrol v. Azerbaijan and Ersoy v. Azerbaijan. These cases illustrate the complexities and challenges in international investment arbitration, particularly concerning jurisdiction and interpretation of investment agreements.
