Jaminan E-Money pada Pariwisata Sariater Subang Menurut Tinjauan Hukum Ekonomi Syariah

Abstract
The existence of DSN-MUI Fatwa Number 116/DSN-MUI/IX/2017 regarding electronic money, makes the ticket guarantee product from Sariater Ciater Subang Tourism, namely e-Money which has been released since its use until now has not received Sharia certification from MUI, it is interesting to study. This study aims to determine the implementation of the guarantee contract for E-Money in Sariater Ciater Subang Tourism and to determine the Compliance of Sharia Economic Law on the E-Money guarantee contract in Sariater Ciater Subang Tourism. The method used is the descriptive analysis method. The results of this study show that first, the implementation of the Sariater Ciater Subang Tourism e-Money ticket card guarantee can be carried out by several Retail Merchant who has collaborated with the tourism management; second, the Compliance of Sharia Economic Law from the aspect of the card management mechanism, there are Sharia problems in the contract aspect, this is because it does not have a contract nomenclature in product operations which causes ambiguity (gharar) and from the part of the fund management mechanism there are no sharia problems. After all, the fund management of this product is separate from Conventional Banks' managers. Adanya Fatwa DSN-MUI Nomor 116/DSN-MUI/IX/2017 tentang uang elektronik, menjadikan produk penjaminan tiket dari Pariwisata Sariater Ciater Subang yaitu e-Money yang dirilis sejak digunakannya hingga sampai saat ini belum mendapat sertifikasi Syariah dari MUI, menjadi menarik diteliti Penelitian ini bertujuan untuk mengetahui Pelaksanaan akad jaminan terhadap E-Money pada Pariwisata Sariater Ciater Subang dan untuk mengetahui Kesesuaian Hukum Ekonomi Syariah terhadap akad jaminan E-Money pada Pariwisata Sariater Ciater Subang. Metode yang digunakan adalah metode analisis deskriptif. Hasil penelitian ini menunjukkan pertama, pelaksanaan Penjaminan kartu tiket e-Money Pariwisata Sariater Ciater Subang dapat dilakukan di beberapa Merchant Retail yang telah berkerjasama dengan pihak pengelola Pariwisata; kedua, Kesesuaian Hukum Ekonomi Syariah dari aspek mekanisme pengelolaan kartu terdapat permasalahan Syariah pada aspek akad, hal ini dikarenakan tidak memiliki nomenklatur akad dalam operasional produk yang menimbulkan ketidakjelasan (gharar) dan dari aspek mekanisme pengelolaan dana tidak terdapat masalah keSyariahan karena pengelolaan dana produk ini terpisah dari pengelola yang merupakan Bank Konvensional.
