Konsekwencje wykorzystywania informacji poufnych w obrocie giełdowym w teorii i praktyce na przykładzie USA oraz Chin

Abstract
Lawyers writing about insider trading often reproduce the assumption that this phenomenon prevents the development of the stock exchange. The author takes on the workshop the assumption, whether the stock market actually cannot develop in the presence of insider trading. The examples of the US and China show that the use of confidential information and the development of exchanges are poorly correlated with each other. Prawnicy, zajmujący się zagadnieniem insider tradingu, często powielają założenie, jakoby zjawisko to miało uniemożliwiać rozwój giełdy. Autor niniejszego artykułu sku-pia się na zbadaniu, czy rzeczywiście rynek papierów wartościowych nie jest w stanie rozwijać się, gdy dochodzi na nim do przypadków insider tradingu. Przykłady Stanów Zjednoczonych i Chin pokazują, że użycie informacji poufnej i rozwój giełdy są ze sobą słabo skorelowane.
