Кримінально-правова охорона прав інтелектуальної власності у Сполучених Штатах Америки / Criminal Legal Protection of Intellectual Property Rights in the United States of America

Abstract
The article is dedicated to the research of criminal responsibility for crimes against intellectual property in the United States of America. The author mentions the following peculiarities of the criminal legal protection of intellectual property in the USA: 1) the blanket disposition of criminal law norms in this area, which is provided with a broad, detailed legislative base and legal precedents that govern the relations related to intellectual property; 2) a combination of criminal and civil liability for offenses against intellectual property rights, special procedure for bringing criminal liability for certain crimes in this area; 3) large punishment for crimes against intellectual property; 4) the absence of a separate chapter in the U.S. Code, which would combine a group of crimes against intellectual property rights. The author also analyzes some elements essential to the crimes against intellectual property, the types and sizes of penalties provided for criminal offenses in the field of intellectual property, as well as the practice of their application. The crimes against intellectual property in the United States include: 1) criminal infringement of copyright (17 U.S.C. §506 Section A); 2) fraudulent copyright notice (17 U.S.C. §506 Section C); 3) fraudulent removal of copyright notice (17 U.S.C. §506 Section D); 4) false representation of a material fact in the application for copyright registration (17 U.S.C. §506 Section E); 5) trafficking in counterfeit labels, illicit labels, or counterfeit documentation or packaging (17 U.S.C. §2318); 6) unauthorized fixation of and trafficking in sound recordings and music videos of live musical performances (17 U.S.C. §2319A); 7) unauthorized recording of Motion pictures in a Motion picture exhibition facility (17 U.S.C. §2319B); 8) trafficking in counterfeit goods or services (17 U.S.C. §2320); 9) economic espionage 17 U.S.C. §1831); 10) theft of trade secrets (17 U.S.C. §1832); 11) counterfeiting Indian Arts and Crafts Board trade mark (17 U.S.C. §1158); 12) circumvention of copyright protection systems (17 U.S.C. § 1201-1205); 13) unauthorized reception of cable services (47 U.S.C. § 553); 14) unauthorized publication or use of communications (47 U.S.C. § 605). Based on the study, conclusions were made on improving the criminal liability for crimes against intellectual property in Ukraine.
