LAW CLINIC AS A NOVEL AREA OF LEGAL EDUCATION IN UKRAINE

Abstract
This article deals with investigating the issues of the legal status of a law clinic attached to an institution of higher education and the role of that clinic in the development of the legal education in Ukraine. It was revealed that the law clinic is a relevant form of providing practical guidance and quality to the legal education. The author believes that despite the long history of its formation and development which covers half a century legal education involving law clinics proves its necessity for the traditionally conservative higher schools of law. The objective of the article is to conduct an analysis of the legal status of a law clinic and to determine its place and role in the educational process of an institution of higher education. The article states that among the current challenges is the issue of improving the efficiency of the legal education, shaping the legal awareness of the people and, relying on that, ensuring the rule of law. The quality of the legal education and the formation of the legal culture are closely interrelated processes. The author defines the organizational form of a law clinic as a structural unit of an educational institution. The purpose of the «Defender» law clinic was defined as creating appropriate conditions for the people to acquire the necessary amount of legal knowledge and skills in its application, providing free legal assistance to persons in need of social protection and support. Suggestions regarding the composition of the law clinic were made. The article emphasizes the need for accepting updated Regulations «On the Activities of a Law Clinic», which would include the provisions on the structural unit, the availability of the legal education involving a law clinic under the licensing conditions of an institution of higher education, the «Fundamentals of Clinical Law Practice» special course, regulations dealing with the work load of the staff of law clinics, financial support, graduate's certificate, and special practice conditions in law clinics. The requirements to be met by a tutor of a law clinic were formulated. The head of a law clinic and tutors must be experienced in representing legal entities and individuals in state institutions, local government bodies, courts, etc. as regards the protection of the rights and interests of the said entities and individuals.
