LEGAL ASPECTS OF JOURNALISM ACTIVITY

Abstract

The article is devoted to the legal regulation of journalistic activities in Ukraine. Freedom of expression and expression and freedom to disseminate information are a natural, imprescriptible right of the individual that belongs to the first generation of human rights. This is the basic need of human in expressing his thoughts and beliefs. Also, these rights serve as the basis for professional journalism activities. The purpose of the work is to determine the legal framework for the freedom of the media in Ukraine and to outline the main problems that arise in connection with enforcement. The authors analysed the international legislation in this area and studied in detail the specialized national legal acts. Thus, an attention has been paid to the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, as well as to the resolutions of the Council of Europe. Examples of court decisions are also given, which highlighted the practice of enforcement. One solution concerns a civil suit for the protection of honour and business reputation, while the other demonstrates the application of the norms of the Criminal Code of Ukraine concerning the problem of bodily injuries to journalists under their professional activities. The attention is focused on the existing problems in the field of legal support of journalist’s activity. First, it is a lack of a single legal act that should regulate the legal status of all types of mass media, including the Internet media. An important problem remains the certain non-system of domestic legal policy in the information sphere. Secondly, the legal status of freelancers, persons, non-journalists, but also the same functions are not regulated: those who are trained in the media, bloggers, and civil journalists. Attention is drawn to the inadequate level of legal culture among the population as one of the possible factors for interfering with journalistic activities.
