LEGAL ASPECTS OF LAND MONITORING IN THE PROCESS OF TOWN-PLANNING ACTIVITIES

Abstract
The attention is paid to the peculiarities of monitoring of using of land and monitoring of land. The problems of assessing the environmental condition of a construction during building process and its subsequent use are considered. In particular, the impact of the construction object on the environmental condition of the environment in different areas (impact on water; influence on the soil cover; impact on atmospheric air; waste construction) is analyzed. It is concluded that the lack of proper monitoring of urban development processes constrains the development of territories and leads to the inappropriate use of their resources. As a result it also does not ensure measures for the protection of land. Based on the provisions of the legislation, it should be noted that monitoring is a necessary procedure for the continuous control over the objects of urban development. And if you take into account the current situation with construction in Ukraine (the growing number of unauthorized construction, deviations from construction norms) the introduction of urban monitoring is a necessary measure. Despite the sufficiently developed legal regulation of land monitoring within the settlements, which can be considered as a structural element of the environmental monitoring system, there are certain disadvantages that cause the inadequate functioning of the land monitoring system, namely: the procedure of collecting information on the state natural resources does not correspond (neither in volume nor in content) the modern requirements and tasks of public administration in this area of public relations; inconsistency between the norms of the legislative acts on the appropriate type of environmental monitoring; lack of modern equipment of monitoring centers in the vast majority of regions of the country etc. Today due to the lack of automated systems that account the negative impact of construction objects on the environment, there is a need to create an information system that will allow providing of the automatic monitoring process in urban planning activities.
