LEGAL ESSENCE OF SOCIAL LEGISLATION OF UKRAINE

Abstract
In the article, the legal nature of the social legislation of Ukraine is examined. Its scientific interpretation is explained. The author stated that for improving the doctrine of social protection, the issue of finalization of the conceptual-categorical apparatus is urgent, as it is in extremely critical condition. The article is consistently considering the content of scientific positions on the legal nature of social legislation representatives of science of labour law, social security law. In conclusion, a number of provisions that reveal the essence of the concept of social legislation are formulated. Given the importance attached to the issue of human rights at the world and national levels, the general conceptual approach is that the person with its vital needs comes to the fore, and the perfection of the legal mechanism is determined precisely as the ability of the latter to meet these needs. The social legislation covers the whole range of legal relationships that relate to the provision of social assistance to different sections of the population, their socio-economic support, and the creation of appropriate conditions for their vital activity. All this is generally aimed at shaping their social security. Accordingly, in order to understand how social legislation is really important in practice, it is necessary to determine its essence by means of scientific interpretation. Proceeding from the legislative and scientific approaches, it is worthwhile to note that for the improvement of the doctrine of social protection, the issue of improving the conceptual framework is urgent since it is in critical condition. So, the mentioned topics are not even scantily explored, however, scientific discussions should be held on the definition of both the term of social legislation and narrower constituent parts of this area. Due to the deepening of the conceptual knowledge of the relevant legal phenomena, it will be possible to improve understanding of the theoretical and practical aspects.
