LEGAL NATURE AND CONCEPT OF COURT DECISIONS IN CRIMINAL PROCEEDINGS IN UKRAINE

Abstract
The article is devoted to the definition of the legal nature and the concept of court decisions, consideration of certain characteristic features of court decisions in accordance with the provisions of the new Criminal Procedural Code of 2012. A court decision is defined as a kind of law-enforcement act of an investigative judge, a court, a judge (including a judgereporter), the jury, which possesses a state-imperious and an obligatory character, adopted in a statutory form (ruling, resolution, judgment) that contains answers to legal questions which arise in judicial activity, and imperious requirements of the need to commit certain acts or occurrence of certain legal consequences. In order to harmonize certain provisions of criminal procedural legislation and improve legislative regulation of the institute of judicial decisions it was proposed to make amendments to the p.1 art.110 of Criminal Procedural Code, art. 31 of Criminal Procedural Code, p.2 art.21 of Criminal Procedural Code.
