Legal obligation to notify to the European Chemicals Agency (ECHA) an information on classification and labelling

Abstract

In the article original fragments of relevant provisions interpenetrating each other have been quoted from the following regulations: • Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures (CLP) • Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 (REACH), referring to the legal obligation to notify to the European Chemicals Agency(ECHA) an information on classification and labelling. This obligation shouldbe made before 1 December 2010 for all substances placed on the market before this date – that’s why awareness of this fact is so essential for the companies to avoid this deadline missing by them. Then in the case of more importers the possibility of notification by one enterprise in the name of the whole group has been mentioned, particularly in case of substanceexporter to the EC, not interested in disclosure full information about substance composition for the sake of business confidentiality. Attention has been paid to fact that aforementioned legal obligation may refer to such substances like waste (if they are economically utilized being transferred to other entrepreneurs for further disposal) and selected polymers. Finally, it has been stated that on the basis of received information the Agency will establish and maintain a classification and labelling inventory in the form of a database available on the ECHA website.
