LEGAL REGULATION OF GENDER EQUALITY WOMEN IN UKRAINE

Abstract

The relevance of the research topic is conditioned by the fact that ensuring the equality of men and women is an integral part of human progress, an element of democracy and an important condition for building a rule-of-law state. The current state of social relations requires further use of the knowledge, skills and creative abilities of women, along with men, requires active involvement of them in various spheres of public life. This necessitates a new content of legal norms as an important factor in regulating the relationship between men and women in society that would ensure their development as equal gender relations. It should be noted that the Law of Ukraine «On ensuring equal rights and opportunities for women and men» stipulates that equal rights for women and men are the absence of restrictions or privileges on the basis of gender, equal opportunities for women and men are equal conditions for the realization of equal rights for women and men. The Constitution of Ukraine, specifically Articles 21, 24, 51, contains norms governing the equality of women and men. Namely, all people are free and equal in their dignity and rights. Human rights and freedoms are inalienable and indestructible. Citizens have equal constitutional rights and freedoms and are equal before the law. There can be no privileges or restrictions based on race, color, political, religious or other beliefs, gender, ethnic or social origin, property status, place of residence, language or other characteristics. The equality of the rights of women and men is ensured by: granting women equal opportunities with men opportunities in socio-political and cultural activities, in obtaining education and training, in work and remuneration for it; special measures on labor protection and health of women, establishment of pension benefits; creating conditions that enable women to combine work with motherhood; legal protection, material and moral support for motherhood and childhood, including the provision of paid leave and other benefits to pregnant women and mothers. So, women formally have the same rights and freedoms with men, but continue to face discrimination on the basis of sex.
