LEGAL REGULATION OF IMPLEMENTING PERSONAL SEARCH: PROBLEMS AND THE WAYS OF THEIR SOLUTION

Abstract
The author of the article, taking into account the latest amendments in the current criminal procedural legislation of Ukraine, has studied the problematic issues of using such a mean of obtaining evidence as a personal search. It has been stated that the absence of the procedural form of carrying out a personal search in the current Criminal Procedural Code of Ukraine threatens further recognition as inadmissible of the obtained evidence. In this regard, it has been offered to enshrine a separate Article in the Criminal Procedure Code of Ukraine, which is going to provide the procedure of carrying out a personal search.
