LEGAL REGULATION OF PROFESSIONAL STANDARDS IN UKRAINE

Abstract
Problem setting. The state policy of Ukraine in the sphere of employment focuses on the innovative model of production development, which requires the transformation of the content of education on the basis of competence-based approach, modernization of vocational education, as well as the training of competitive workers able to meet the high demands of the modern labor market. Under such conditions, the study of professional standards is very relevant as the basis for the development of educational programs, the formation of qualifications, the organization of remuneration, etc.. Target of research. The purpose of this article is to identify the legal nature of professional standards, their importance, principles of development and approval, as well as the relationship with the qualification characteristics of the worker’s profession. Article’s main body. The article examines the prerequisites for the emergence of professional standarts on the basis of the study and analysis of current legislation in the field of labor and education, their legal nature, the tasks they perform, the procedure for development and approval, as well as the comparison of professional standards with the qualification characteristics of workers, identifying common and distinctive features between them. Conclusions and prospects for the development. Based on the above, it is concluded that, firstly, professional standards do not replace the already developed and existing qualification characteristics of the professions of employees. Despite the commonality of tasks that are achieved with the help of professional standards and qualification characteristics (in particular, the development of educational programs, the establishment of qualifications in accordance with the NQF, the definition of requirements for qualification and special knowledge of employees, the regulation of labor, the tariffication of positions and professions for the organization of remuneration, and the like), they should be distinguished by content, as well as the order of development and approval. Secondly, both professional standards and directories of qualification characteristics of professions of employees, developed and approved in accordance with the legislation, are normative documents required for application along with the norms of the Labor code and other normative legal acts of Ukraine in the field of labor and education.
