Legal regulation of the investigation of accidents and incidents at sea in the European Union

Abstract

The article is devoted to the study of legal acts of the European Union aimed at establishing a procedure for the investigation of marine casualities and marine incidents, as well as the establishment of special competent authorities to improve the practice of such an investigation. The purpose of this article is to identify the main areas of legal regulation of the investigation of marine casualties within the European Union. The author analyzes the directives adopted in the European Union due to large-scale sea accidents, such as the accident of the ferry Estonia, the tankers Prestige and Erica, the practice of the European Maritime Safety Agency and the Consultative Technical Group for Cooperation in Marine Accidents Investigations. The author comes to the conclusion about the positive experience of the European Union in the establishing of competent authorities for the investigation of marine casualities and marine incidents and for the recording of marine accidents. The development and functioning of the European Marine Casualty Information Platform is evaluated positively. There is also a somewhat point-based approach to the adoption of new regulations, based mainly on the negative experience of previous major accidents.
