Organizationally-legal aspects of certification procedure of police officers

Abstract

The article investigates the regulatory-legal framework for certification of police officers, analyzes the peculiarities of the procedural order for the certification of police officers, reveals the main shortcomings of the legal regulation of the certification of police officers and suggests possible ways of their solution. The author notes that the effectiveness of the activities of employees of the National Police of Ukraine directly depends on the level of their professionalism, which, like any element of the personal characteristics of the activity, is an appraisal category that evaluates business, professional, personal qualities, educational and qualification levels, physical preparation on the basis of profound and comprehensive study, the correspondence to the positions is determined, as well as the prospects of the official career of police officers. The determination of the professional suitability of a police officer is a certification process that plays an important role in improving the human resources, creating an updated, powerful and capable apparatus of the National Police of Ukraine, which contributes to the further implementation of the tasks entrusted to the National Police. At the same time, today the very procedure for conducting attestation has many shortcomings, which, in general, leads to a negative attitude towards the reform of the National Police of Ukraine by determining bias and unjustified conclusions of the certification commissions. It is noted that most of the controversial situations that occur during the certification of police officers are the result of an imperfect Instruction on the procedure for conducting certification of police officers. This applies directly to both the Instruction and the forms of documents that do not provide for relevant paragraphs, which in the future entails legal disputes and negative legal consequences. The solution of this issue is possible only if there are significant changes to this Instruction and the forms of documents enclosed to it.
