LEGAL REGULATION OF TRANSPLANTATION IN UKRAINE

Abstract
In this study, we examined the legal regulation of transplantation from a position of “presumption of consent” conditions of legality transplantation of human organs or tissue. Studied three variants of the legality of the removal of organs for transplant deceased: the forced removal of organs and tissues; total removal of organs and tissues; routine removal of organs and tissues. The analysis is a legal phenomenon as “presumed consent” and “presumption of disagreement”.
