LEGAL REGULATION PROBLEMS OF THE RENT AGREEMENT AND LAND SERVITUDE FOR RENEWABLE ENERGETIC DEMANDS

Abstract
The article analyses practical aspects of execution of a rent agreement and land servitude for renewable energetic demands. It’s very current problem for Ukrainian energetic because a lot of questions exist in possibility to have right of use lands in a legal way. In particular, the problems exist in the legal area and often associated with the possibilities of using land in various forms of property. Ukraine’s renewable energy market becomes ever more important, especially with the steep increase in gas price and the adoption of green-tariff price incentives for electricity from renewable energy sources in 2009. The government set a green tariff for power produced from renewable sources which is two times higher than the wholesale price for power produced from traditional sources. It is widely expected that the introduction of the green tariff will boost activity in the sector. Other preferences include duty-free imports and exemptions from value-added taxes. Ukraine’s mid-term energy strategy targets a level of 10% of renewables until 2030, the potential for renewables being much higher. Like so much in Ukraine, renewable energy has enormous potential. But while it is developing, it remains held back by insufficient investment. Developers, manufacturers, investors and other renewable energy industry stakeholders need to know that they will not have any problems because of imperfect legislation so they can adjust their business decisions accordingly. Nowadays, it’s necessary to improve Ukrainian legal system and make it more modern and useful for companies which want to generate energy from renewable resources.
