LEGAL STATEMENT OF PROFESSIONAL SPORTS CLUBS AND PROFESSIONAL SPORT LEAGUES: PROBLEM ASPECTS

Abstract
The modern institutional system of Ukrainian sport may be characterized as a mix of two organizational models: free market type (“western model”) and non-market type (“soviet model”). The main driver of sport in the Western countries is private interest (sports market), and the main priority of Soviet sport was the public interest (so called mass sport). Accordingly, the main organizational element of the “Western” system of sport is the private sports club and associations of sports clubs (professional sports leagues). On the contrary the main actors in domestic sport are state and public (in fact – quasigovernmental) organizations. That is, first of all, about sports federations and sports associations. At the same time, mass sports, like other sports, are currently in decline. However, despite the state's inability to ensure normal financing of sport, it nevertheless occupies a dominant position in the institutional system of domestic sport. Such an interventionist approach has survived since the Soviet era. At the same time, it should be emphasized that in the conditions of a chronic under-financing of sports, the institutions of professional sport should take dominant positions. Professional sports, as a an economic activity, is able to accumulate the funds necessary to build not only, in fact, professional sports, but also the whole system of domestic sports. So, having switched to the market model of economic development, our state did not provide the possibility of transition to the same model of development or domestic sports. The legal framework of professional sports remains at a very low level. At the same time, the legal status of the sports club, as the primary link of the organizational system of both professional sports and sports, in general, is, in fact, not defined. The Law of Ukraine “On Physical Culture and Sports” of 24.12.1993 names sports club as one of the participants in the field of sports. But the legal definition of a sports club is extremely abstract and does not make it possible to clearly define its legal status. The key aspect for the development of sports in foreign countries is the proper conditions for doing business. In particular, it is very productive ti combine sports clubs into professional sports leagues to optimize the commercial activities of each club and sports league in general. Ultimately, this leads to the emergence of free funds, which are aimed at the development of the entire sports system. Consequently, the key to successful reformation of the domestic sports system is to ensure the normal development of professional sports with the leading role of professional sports clubs and professional sports leagues. The Law of Ukraine «On Professional Sports» should become an important part of such a reform.
