Legal terminology and peculiarities of its translation from English into Ukrainian

Abstract

The article is a study of the features of the translation of legal terminology. Terminology is the most dynamic component of the lexical system of language which is characterized by constant development and neologization, an important factor of which, along with the effect of inter-language tendencies, is the lexical influence of other languages. The current stage of the development of Ukrainian terminology as well as the terminology of many European languages, is characterized by a rapid increase in the number of English-language borrowings. There is a notable influence of English terminology on the development of the Ukrainian legal terminology system, the formation of which within the framework of a sole European legal system is determined by the integration processes in the world community and the internationalization of national law. This explains a special interest in the problem of borrowing from the English language and the translation of purely English terms into the Ukrainian language. As a result of the destruction of the semantic relation between the meanings of one word, the collapse of polysemia and the formation of homonymy occur. The main feature of homonyms is that they are facts of different semantic fields. This prevents their collision in similar contexts. The very fact of the existence of homonyms cannot be a hindrance to the correct understanding of the text. In the terminology of law homonymy can be directly related to the semantic development of a word or can be the result of a sound coincidence of different words. In addition, this semantic phenomenon is inherent in the legal vocabulary which enters into a homogeneous relationship with units of other terminology systems. The hierarchy of terms assumes their location in accordance with the structure of a certain field of knowledge, in our case, of legal science. The systematization of hierarchical relationships between terms allows us to identify the essential links and relationships between concepts, to clarify the place of each concept in the conceptual system, to check the completeness of the term, to identify the shortcomings of terminology (synonymy, homonymy, different interpretations of concepts, etc.). Thus, special terminology of law is considered by us as a totality, all elements of which are organized into a system, and it is these relations that determine the place of each element in the system of English legal terminology.
