LEGALITY AND FREEDOM - THE DETERMINANT ELEMENTS OF THE IMPLEMENTATION OF THE PRINCIPLE OF EQUALITY OF RIGHT

Abstract
Legalityandequality of rights are twophenomenathat are successfullyinterwovenwiththeirimplementation in therule of law. The systemthataccentuatesthissuccessful tandem isthat of justice, which, if it acts in strict accordancewiththelawandrespectstheprinciples of effectivejustice, willcertainlycontributeenormouslytotheimplementation of legality, freedomandequality, andthelatterwillnotbeabletogoseparatelyneither in law nor in fact. Thismakes evident theinseparability of legalityandfreedom of equality. Andthisisentirelytrue, sincefreedomand de facto equality are based on therule of law, andthefinding of de facto equalityisnothing more thantheresult of theobservance of theprinciple of legality in theapplication of therulesgoverningequalityandthefreedom of thesubjects of law.
