LEGISLATION ON LANDING OF PUBLIC PERSONS IN XVII – XIX CENTURIES ON TERRITORIES OF UKRAINE

Abstract

The article is devoted to the study of the history of the development of domestic legislation on attacks on the lives of statesmen. The features of this institute were determined in the 17th-19th centuries, in particular, in the systematic code of laws «The rights of the Little Russian people». After the death of Peter the Great, he established in Ukraine a rigorous regime changed to a somewhat more favorable attitude of the Moscow government. Under the royal decree of August 28 (September 9) in 1728, known as «Decisive points for the Hetman Danylo Apostol», representatives of the Cossack elder, a special codification commission was formed, which completed work in 1743 with the drafting of a collection of laws entitled «Rights, for which the Little Russian people is suing». In Chapter III, «On the Highest Honor and Power of the Monarch», which was part of the Special Part concerning the criminal law, there were political crimes against the monarch and the state. Item 1 of Article 1 «On the prerogative, that is, the superiority of the high-ranking state or Majesty» Chapter III states the supremacy of the monarchy: «Monarch or autocrat and ruling emperor is the supreme power, that is, over all the supreme, appointed and established from the only Almighty God, that For the sake of the statutes and decrees of his high-monastic people to all subjects for the right to count and with all due respect and obedience, it is necessary to exercise, nobody else, by his order, to create greedy laws and not establish the rights in force».
