Legislative restrictions on the legal status of individuals guilty of crimes against the bases of the national security of Ukraine

Abstract

There is a demand in Ukrainian society to prevent individuals guilty of crimes against the bases of the national security of Ukraine from making important governmental decisions after restoring the sovereignty of Ukraine on the territories currently annexed and occupied by the Russian Federation. The analysis of the national legislation along with the international acts on Human Rights show that the above mentioned individuals can neither be deprived of, nor lose their citizenship. Therefore, it is suggested to introduce amendments to the Criminal Code of Ukraine, such as supplementary penal sanctions, namely temporary restrictions on the right to vote and on electoral eligibility to the bodies of State Authority and to the local self-governments, restrictions on entering public services and self-governments. The corresponding amendments are proposed to be introduced to some other laws of Ukraine. These suggestions do not contradict the Constitution of Ukraine, its valid legislation and the international acts on Human Rights. The article also examines some historical examples of suffrage deprivations. Some attention is paid to the draft laws in the Verkhovna Rada of Ukraine that are similar to those suggested by the author
