Sources and forms of international customs law

Abstract
The article focuses on the clarification of the essence of existing doctrinal approaches to the understanding of the concept of “international customs law source” and the concept of “the form of international customs law”, as well as the substantiation of the author’s vision on their relationship. It is noted that the study of international customs law sources has been given considerable attention by both Ukrainian and foreign scientists. Despite this, the problem under study in the international customs law theory has not yet been resolved, because most of the published works were devoted to the analysis of the content of certain international customs conventions, or acts of international organizations, or the general description of the author’s vision on the types of international customs law sources. The emphasis is placed on the inappropriateness of the interpretation of the term “source of law” through the term “form of law” and the inefficient use of the legal form-based approach to understanding the sources of law in order to establish a correlation between the concept of “international customs law source” and the notion of “the form of international customs law”
