Abstract
The article deals with the lockout as a legal phenomenon in the settlement of collective labor disputes and the problem of the implementation of the right to lockout in the national labor legislation. The Constitution of Ukraine provides all workers with the right to protect their rights, that is, the right to strike. In turn, the question arises as to the need to regulate the lockout at the legislative level. In case of infringement of their own rights, workers may apply a strike mechanism. Therefore, the question arises of limiting the employer's right to declare a lockout in response to a strike of workers. The state regulates the rights and obligations of both workers and employers, so it is necessary to protect both parties and give them equal opportunities to protect their rights. In addition, the level of development of the state, the consciousness of society, socio-economic indicators and other indicators affect the acceleration of consideration of this issue. In order to find out the need for expediency of the introduction of a lockout in the territory of Ukraine, we must analyze the experience of leading foreign countries: France, Great Britain, the Republic of Portugal, Israel, the United States, Canada regarding the legislative regulation of this issue. For a detailed and complete consideration of this issue, it is necessary to identify the main features of this legal phenomenon, the emergence of positive and negative consequences in the case of the implementation of the right to lockout. Since the emergence of such a right, employers can abusive them and significantly limit the possibilities of employees. Importance is the opinion of domestic scientists about this legal phenomenon, because taking into account all important circumstances is the key to solving the problem. Therefore, it is necessary to establish the expediency of securing the lockout in the labor legislation of Ukraine, since this legal phenomenon in the territory of our country is poorly researched and very relevant.
