Main directions of the United Nations normative activities in the field of ensuring human rights for freedom of conscience and religion

Abstract

Ensuring human rights and freedoms, in particular the right for freedom of conscience and religion is one of the priorities in the international community. Evidence of this is the standard-setting UN activities in the relevant field. Ukraine, while developing its own legal system and legislation, abides by its international obligations, including the protection of human rights for freedom of conscience and religion. The aim of the article is to analyze the basic UN documents in the area of conscience and religion freedom and to highlight the main directions of the rule-making development of the Organization for the protection of human rights for freedom of conscience and religion. The scientific novelty of the article is to highlight the main United Nations activities to ensure human rights for freedom of conscience and religion, to analyze the basic UN documents for guarantees human rights for freedom of conscience and religion, to determine the conformity of Ukrainian legislation in the area for conscience and religion freedom with the basic UN acts. Conclusions. Ukraine, as the founding state of the United Nations, directs its activities in the field of human rights protection in accordance with the statutory documents of the Organization. The following basic directions of the normative activity of the United Nations on ensuring the human rights to freedom of conscience and religion are singled out: 1) general principles of protection human rights for freedom of conscience and religion; 2) counteracting discrimination based on religion or belief; 3) protection of the rights for freedom of conscience and religion of certain groups and categories of persons. Our country has ratified the main UN human rights pact and conventions, including the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Rights of the Child, the UN Convention on the Status of Refugees, etc. In addition, when improving national legislation on freedom of conscience and religion, Ukrainian lawmakers take into account the provisions of other UN acts – both binding and recommendatory. Due to this, the national legislation on the protection of religious human rights generally complies with international acts of the United Nations. At the same time, a number of Ukraine's pact and conventions still need to be ratified, including those relevant for our state, such as the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, etc.
