MANAGERS’ REMUNERATION WHILE THE EMPLOYMENT RELATIONSHIP IN THE VIEW OF EMPLOYER’S CRITICAL FINANCIAL SITUATION

Abstract

Managers of the establishment on the employer’s behalf are distinctive group of employees. Their special status is particularly visible while employer’s financial crisis. It is regulated especially by two acts - Bankruptcy Law and Restructuring Law. The paper presents how the employer’s insolvency or the risk of insolvency differently form their position by the mechanisms which have impact on their remuneration. The institutions of recognition the specific part or all the remuneration ineffective and setting their claims under employment relationships in further category than other’s employees are discussed. The author makes an attempt to critically evaluate this regulation and the validity of its introduction.<br/><br/>
