Medical Neutrality as a human rights in patient care protection concept: experience of Ukraine

Abstract

New for Ukrainian legal system concept of "medical neutrality", which has beendesigned to serve as a reliable "Umbrella" for human rights in the field of health care, is revealed. An attempt has been made to lay the theoretical foundations of the national concept of the specialized international and regional standards, the doctrine of scientific achievements of scientists and experience of foreign countries. Singled out features and functions of medical neutrality, formulated principles thereof. Author's definition of the concept of medical neutrality, which means the right-human concept providing the participants of medical legal protection and respect, guarantees the safety of the organization and provision of medical care at the time armed conflicts, and in peacetime, obliges health professionals to promote equal access to medical care and provide medical care to all who need it, without discrimination for any of the signs; is proposed. The basic theoretical approaches to the understanding of the concept of medical neutrality and gaps in national legislation of Ukraine in the context of adherence to the concept of medical neutrality, as well as formulated suggestions for eliminating the identified gaps.
