Міжнародні стандарти захисту тварин та їх імплементація до українського законодавства / International Standard for the Protection of Animals and its Implementation in Ukrainian Legislation

Abstract
The article deals with the evolution of international legal standards of the protection of animals. Also, it analyses the international conventions, including EU agreements, which contain provisions relevant to animal welfare. The authors draw the conclusion that there are many criteria for the classification of international legal acts which protect the rights of animals. For example, such criteria include the level of application or the features of individual biological species of animals. Only a few of abovementioned international acts have been ratified by Ukraine. In addition, even ratified international acts are not implemented properly in Ukraine. The reasons for this are the lack of a systemic policy of state, legal nihilism and a low level of animal’s protection culture among the population. An analysis of judicial practice shows that criminals rarely held adequate criminal responsibility for cruelty to animals. In addition, the authors describe the mechanism of protection of animal rights in Ukraine and explain the features of the bills on making amendments in the sphere of animal protection and the process of implementation of universally accepted legal standards in our state. The authors analyze the draft legislation on the animal’s protection, which are now examined by the Verkhovna Rada of Ukraine. One of them, on the authors’ opinion, is quite progressive and contains provisions that will elevated the protection of animals to a new level, bringing national legislation closer to European standards. Nevertheless, despite numerous public demands, this draft law has little chance of being approved.
