Niezdolność do podjęcia istotnych obowiązków małżeńskich z przyczyn natury psychicznej. Aspekt sądowo-psychiatryczny

Abstract
Od co najmniej 20 lat znaczna większość spraw sądowych o nieważność małżeństwa prowadzonych jest przez trybunały kościelne głównie z nr. 3 kanonu 1095 nowego kodeksu prawa kanonicznego, to znaczy z tytułu niezdolności psychicznej osoby do podjęcia istotnych obowiązków małżeńskich. Często są to sprawy trudne i sędziowie kościelni potrzebują opinii sądowo psychiatrycznej lub psychologicznej. Celem tej pracy jest zapoznanie psychiatrów i psychologów z istotną wiedzą dotyczącą nowych uregulowań zawartych w nr. 3 kanonu 1095 aktualnego kodeksu prawa kanonicznego. Zgodnie z opiniami wybitnych kanonistów autor przedstawia prawne i psychiczne warunki zawarcia ważnego małżeństwa, zdolność do podjęcia istotnych obowiązków małżeńskich oraz przyczyny psychiczne niezdolności do zawarcia małżeństwa. Autor podaje kilka przyczyn psychicznych powodujących niezdolność psychiczną do podjęcia istotnych obowiązków małżeńskich : zaburzenia osobowości i alkoholizm, które wykluczają wyłączność i naturalne dopełnienie zgody małżeńskiej. W końcu autor przedstawia warunki jakie powinna spełniać sądowa opinia psychiatryczna i psychologiczna.
