NORMAL SUPPLY OF TRANSBOUNDARY COOPERATION AT NATIONAL LEVEL IN EUROPE

Abstract

The article analyzes the history of legal norms regulating cross-border cooperation with the constant interconnection of the state and subnational unit. Policies for the implementation of cross-border cooperation are based on a territorial political capability. It requires the institutionalization of cross-border cooperation in line with the concept of multilevel governance and an instrument for addressing specific cross-border issues. Taking into account such factors as type of decentralization, intergovernmental relations, the influence of supranational actors in Europe, one can see the potential admissibility degree of the cross-border cooperation for States in the process of implementing the EGST Regulation in order to understand why the application of EGSTs in Europe may be different. There is no comprehensive study using the comparative method and legal analysis of the legal norms of organization and development of cross-border cooperation in the national legislation of European countries, especially in the constitutional law of the states. As a result, the purpose of this paper is to study interrelations of state and subnational units in the process of organizing cross-border cooperation in Europe and their implementation in national legislation. Using a comparative method and legal analysis, the author has identified some key features which have influential role in the public policy towards cross-border cooperation. Such features are: the level of decentralization, the relationship between the state and the sub-national units, and, if possible, litigations in the field of cross-border cooperation. To a larger extent, the scope of the international capabilities of the regions depends on their interrelation with the state and with their national authorities. On the basis of the analysis the classification of the model of cooperation of the state in cross-border cooperation has been made using the empirical experience of some European countries.
