Abstract
The maintenance contract ends in practice between individuals and is recognized by both literature and jurisprudence. This type of contract is a legal construction, of objective practical necessity whose structure and fixation has been achieved by the judicial practice and the specialized legal literature.According to art. 839 CCRM, through the contract for the alienation of the goods on condition of life maintenance, a party (the beneficiary of the maintenance) undertakes to give the other party (acquirer) immovable or movable property and the acquirer undertakes to provide the beneficiary with the maintenance in kind food, care and help needed for the time it will live, as well as the funeral.
