THE CONTENTS OF PRINCIPLE OF LEGALITY IN ACCORDANCE WITH ARTICLE 1 OF THE FIRST PROTOCOL TO CONVENTION FOR THE PROTECTION OF HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS

Abstract
The article is devoted to the analysis of the content of the lawfulness principle in accordance with Article 1 of the First Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms. There is examined the European Court of Human Rights practice concerning the compliance by the respondent state with the requirements of legality when it takes measures aimed at deprivation or restriction of right oh property. On the basis of an analysis of the European Court of Human Rights decisions there is concluded that the notion of legality means that any interference with the exercise of a person’s right of property must correspond with national law and not be violent. Particular attention is paid to the study of the term «law» meaning as it is interpreted by the European Court of Human Rights.
