OBLIGATIONS OF INTERNATIONAL COURTS TO IMPLEMENT EQUALITY IN CRIMINAL LAW

Abstract

In this article, the obligation of international courts to apply equality, especially in the field of criminal law, is discussed. The article emphasizes the importance of equality in criminal law and states that international courts have an obligation to decide in accordance with the principle of equality. The article examines the obligations of international courts, especially international criminal courts, to comply with the principle of equality. In this context, it is emphasized that all kinds of discrimination based on gender, race, language, religion, nationality and other grounds of discrimination should be prevented. The article emphasizes that international courts must take appropriate measures to prevent discrimination and protect the rights of victims, in addition to their obligation to make decisions in accordance with the principle of equality. These include measures such as the fair conduct of criminal proceedings, the protection of victims' rights, and increased penalties if crimes are committed because of discrimination based on gender, race, religion or other characteristics. The final part of the article emphasizes the importance of the obligation of international courts to make decisions according to the principle of equality. It is also recalled that international courts should take appropriate measures to prevent discrimination and protect the rights of victims.
