Ochrona prawa oskarżonego pozbawionego wolności do kontaktu z obrońcą w postępowaniu karnym

Abstract
Przedmiotem niniejszego opracowania jest przedstawienie problemu realizacji uprawnień oskarżonego pozbawionego wolności do kontaktu z adwokatem. W tym aspekcie przeanalizowano przepisy Kodeksu postępowania karnego (art. 245, 73, 301 k.p.k.) stanowiące urzeczywistnienie ogólnej zasady prawa do obrony (art. 6 k.p.k.). Przeanalizowano także dorobek Europejskiego Trybunału Praw Człowieka w Strasburgu dotyczący przedmiotu omawianego w niniejszym opracowaniu. Wyznacza on europejskie standardy legislacji, jak też może stanowić punkt odniesienia do prawidłowego stosowania omawianych regulacji krajowych, w tym tych funkcjonujących w polskim Kodeksie postępowania karnego.
