Od harmonizacji do fragmentaryzacji międzynarodowego prawa patentowego. Włączenie problematyki standardu ochrony patentowej w zakres regulacji umów o wolnym handlu

Abstract
Włączeniem kwestii ochrony własności intelektualnej do zakresu bilateralnych lub regionalnych umów o wolnym handlu poprzez takie rozwiązania prawne, które wykraczają poza to, co zostało ustalone w ramach porozumienia TRIPS jako standard minimalny (tzw. klauzule TRIPS-Plus), rozpoczął się proces kształtowania nowego międzynarodowego standardu ochrony własności intelektualnej. Przyjęcie tego standardu jest odejściem od konsolidowanego multilateralnego systemu harmonizacji prawa własności intelektualnej (tworzonego przez system konwencji WIPO oraz Porozumiecie TRIPS) w stronę systemu sfragmentaryzowanego, w ramach którego podstawowym punktem odniesienia są bilateralne lub regionalne porozumienia o wolnym handlu. Tym samym, przede wszystkim ze względu na różnorodność klauzul TRIPS-Plus oraz dynamiczny wzrost liczby nowych porozumień o wolnym handlu, aktualnie obowiązujący międzynarodowy standard ochrony własności intelektualnej staje się trudny lub wręcz niemożliwy do jednoznacznego zdefiniowania i opisania.
