Окремі питання правового регулювання праці засуджених до позбавлення волі / Some Issues Regarding Legal Regulation of Labour of Persons Sentenced to Imprisonment

Abstract
Theoretical provisions of labour as the main means of correction and resocialization of persons sentenced to imprisonment have been researched. Attention has been paid to collisions of legal regulation of labour of persons sentenced to imprisonment in Ukraine stipulated by complex and inter-branch character. Differences between labour of persons sentenced to imprisonment from labour of free citizens have been addressed. Current legal norms of criminal penitentiary legislation which regulate work of persons sentenced to imprisonment have been analyzed. Particularly, advantages and disadvantages of amendments to legislation which establish labour as the right not the obligation of persons sentenced to imprisonment have been analyzed. Attention has been paid to certain aspects of arising of labour relations with persons sentenced to imprisonment, their attraction to the socially useful paid labour and protection of their rights in labour activities. Attention has been drawn to the issue of payment for labour to persons sentenced to imprisonment and their incitement to productive and effective work. Recent research and publications on various views which deal with these issues have been analyzed.
