ON THE LEGAL NATURE OF THE RIGHT FOR DIVIDENDS

Abstract
Investigating the issue of the legal nature of the shareholder’s right for a dividend, the author shows that there are two different rights mediating the property interest of a participant to receive profit of a corporate company. The first one is a corporate right for a dividend existing as long as the participation in the corporate company lasts. It is represented in the turnover by a corporate share as a transferable symbol. This right is under the judicial protection, but at the same time it is impossible to realize it. The corporate right for a dividend is a prototype of obligatory rights arising from it each time the conditions provided by law occurs.
