On the problems of using victimological data in the process of preparing and conducting judicial actions

Abstract
Article is devoted to development of theoretical bases of the victimological cognition of a person in criminalistics and formation of the scientific and practical criminalistical recommendations for the bodies of the judicial examination of the criminal proceedings connected with the collection and use of victimological data during the process of the crimes solving and investigation. The main directions of the victiminological data use in criminalistics have been analyzed. The criminalistical recommendations with the use of the victimological data during the process of the preparation and conducting of the judicial actions have been worked out. Based on the generalized analysis of modern law enforcement practice in Ukraine, the article concludes that during the judicial investigation into certain types of crimes the person of the victim (the injured party) is not given a proper and thorough examination. The article suggests certain scientific and practical recommendations in order to increase the efficiency of the process of collecting and using victimological data in criminal legal proceedings. It offers the standard form a questionnaire of the victim, that serves as a basis for collecting and using victimological data in criminal legal proceedings and as a basis for building a profile of the victim of the crime. The article substantiates that the use of victimological data in preparing for and conducting judicial actions follows certain patterns that include the peculiarities of the category of crimes under investigation, the judicial situation, the nature and type of proceedings, the object of tactical impact, the aim and tasks of an judicial action.
